Defence Pension Adalat on 25th and 26th April, 2013

As per the Annual action Plan of Controller General of Defence Accounts, New Delhi in consultation with the Ministry of Defence, the Principal Controller of Defence Accounts (Pensions) Allahabad will be organising the 117th Defence Pension Adalat at Bhatinda (PB) on 25th and 26th April, 2013 for redressal of grievances of Defence pensioners including Defence Civilians drawing pension through PUBLIC SECTOR BANKS, TOs’ and DPDOs in the State of Punjab and adjoining areas.

Objective

Any Defence Pensioners / Defence Family Pensioners / Defence Civilian and their families having any specific grievances relating to sanction or disbursement of Defence pension are requested to submit their representation, in writing, in duplicate to :

Kindly Note
Applications can either be sent by post or by E-Mail
Two copies of the applications should be sent
Photocopies of Pension payment order, Corr PPO, discharge certificate (wherever required) and other documents must be enclosed
Each application will be allotted a unique Adalat Registration Number. The same should be quoted in all future correspondence.
Individual call letters notifying the date and venue of the Adalat will be sent in due course
Incomplete and unsigned representations will be rejected.
The Date of the Pension Adalat on dt 25 th & 26th April, 2013 at Takshilla Hall, Bhatinda Mily Stn.

TA/DA will not be reimbursed to pensioners/individuals attending the Adalat for redressal of their pension related problems.

Sub: - Non payment of Dearness Relief on Disability Element While on Re Employment.

The payment of dearness relief during re-employment / employment / permanently absorption of pensioners / family pensioners under the Central or State Government or in a Statutory Corporation / Company / Body / Bank under them in India or abroad is not being regulated correctly by various Pension Disbursing Authorities. Where some Pension Disbursing Authorities are disallowing dearness relief to re-employed pensioner of commissioned officer on disability element, others are allowing in few cases. Similar irregularities 
have been noticed in case of pensioners of PBOR. The instances of not allowing dearness relief to family pensioners during their employment are also drawing attention of this office/Ministry from time to time. The position on the subject is though clearly stipulated in Ministry of Personnel, Public Grievances & Pensions. Deptt of P&PW letter No. 45/73/97-P&PW(G) dt. 2nd July, 1999 and Ministry of Defence letter No. 79(1 )/95/D (Pen/Services) dated 2th August 2000 and Deptt of P&PW UO No. 41/42/2007-P&PW(G) dt. 3-4-2008. However, position is re-clarified as under for uniform implementation of above orders.

(a) In case of re-employed pensioners who hold Group 'A’ post or posts of the ranks of commissioned officers at the time of their re-employment will not he entitled to any dearness relief on pension on the fact that:

(i) A certain portion of pension is taken into account and is not entirely ignored.

(ii) The pay in the post of re-employment is not required to he fixed at the minimum of the scale in all cases, and

(iii) Dearness allowance at the rates applicable from time to time is also admissible on the pay fixed on re-employment.

(b)(i) The entire pension admissible is to be ignored in the case of civilian pensioner who held posts below Group 'A’ and those ex-servicemen who held posts below the ranks of commissioned officers, at the time of their retirement. Their pay on re-employment is to be fixed at the minimum of the pay scale of the post in which they are re-employed. Such civilian pensioners will consequently be entitled to dearness relief on their pension at the rates applicable from time to time.

(b)(ii) The ex-servicemen (PBOR) who retired before attaining the age of 55 years and re-employed thereafter and their pay fixed at a higher stage because of advance increments and no protection of the last pay drawn is being given, the pay should he treated as fixed at a minimum only for the purpose of ignoring the entire pension and allowing dearness relief on pension.

(c) The disability element is part of disability pension. therefore position explained at a & h above will also apply for regulating dearness relief on disability element during re-employment of pensioner drawing disability 
pension.

(d) The family pension received by the eligible central Govt. employees/Armed Forces pensioners is, in any case, not taken into account in determining their pay on employment therefore, dearness relief at the rates applicable from time to time shall he admissible on their family pension.

Incorrect payment of pension is not only infringement of Govt. orders but also cause of concern to pensioners. It is, therefore, requested o instruct Pension Paying Branches / CPPC / Offices / Treasuries under your jurisdictions to regulate the payment of dearness relief on pension /family pension on re-employment / employment / permanently absorption of pensioners/family pensioners as explained above.

Early Decision – No need to pay Arrears on DA and 7th CPC

Decision in the right time –will avoid more funds to allocate as arrears!

At last, the most eagerly awaited announcement of additional dearness allowance has been declared by the cabinet, due from January 2013 to Central Government employees and Pensioners.

In general the announcement of dearness allowance has been made in the month of March every year. But this year this has been declared in the month of April. Though it was announced after some delay, there is no any loss, as the dearness allowance hike has to be paid with effect from 01-01-2013.

Before this announcement, there was a rumour that 50% dearness allowance will be merged with basic pay or otherwise dearness allowance will not be hiked, but the cabinet committee decision cleared these doubts.

Employees and Pensioners will get one more month arrears from January to April. Government has to allocate more funds as arrear due to delay.

If the decisions concluded in the right time, there will be no chance to allocate more fund for the payment of arrears and also prevent practical problems to accounting staff.

Even the National anomaly committee, after six years it was formed, has not solved all the problems raised due to the implementation of 6th CPC.

After the implementation of 6th CPC in 2008 with effect from 01.01.2006 , arrears had to be paid to Central Government servants. To avoid the additional financial burden, the Central Government decided to pay the arrears’ in two installments in 2008 and 2009. For this, government had to allocate more fund from budget. It can be avoided by early constitution of 7th pay commission.

So, to find the solution to all including disbursing authorities, setting up of 7th Central Pay Commission at early stage to implement in the right time, the same is demanding by the central trade unions and associations.

Every decision in the right time –will avoid more funds to allocate as arrears!

OFFICE MEMORANDUM

Subject: Launch of RTI web portal for online filing of RTI application.

A Web Portal namely RTI Online with un https://rtionline.gov.in has been launched. This portal, developed by NIC, is a facility for the Indian Citizens to online file RTI applications and first appeals and also to make online payment of RTI fees. The prescribed fees can be paid through Internet banking of State Bank of India and its associate banks as well as by Credit/Debit cards of Visa/Master, through the payment gateway of SBI linked to this site.

2. At present, this facility is available only for Department of Personnel and Training (DoPT). It is planned to extend this facility to all the Ministries/Departments of Govt. of India within a month. This facility is presently not proposed to be extended for field offices/attached/subordinate offices.

3. This system would work as RTI MIS also. The details of RTI applications received through post should also be entered into this system. The system would also provide for online reply of RTI applications, though reply could be sent by regular post also.

4. It is requested that full co-operation may be extended for the successful implementation/roll out of this facility. First of all, it is necessary that the RTI Nodal Officers, officials of RTI Cell and all the CPIOs / FAAs of the Ministries/Department sare trained to use this facility. Arrangements have been made to provide training to the RTI Nodal Officers, RTI Cell officials and the NIC/1T personnel attached with the Ministries/Departments, by DoPT with the help of NIC, within next 2-3 weeks. The schedule for such training would be intimated to the RTI Nodal Officers directly. It is requested that training for all the CPIOs and FAAs may be organized by the concerned Ministry/Department, through these officers trained by DoPT / NIC5. The screen shot of the home page of the portal, the terms and conditions and 
copy of the O.M.No.1/1/2013-IR dated 08.04.2013 issued in respect of DoPT are enclosed for information.

6. The contents of this 0M may be brought to the notice of all concerned.

No merger of D.A. but seventh pay commission likely this year

According to our sources in New Delhi, there is no chance of any merger of Dearness Allowance with basic pay as demanded by the associations. But the Government is considering the formation of seventh pay commission.

The seventh CPC is scheduled to be effective from 1.1.2016 and if it is formed this year, there will be ample time to finalize it’s recommendations. Moreover, if it is not effective from an earlier date, the Govt. will be free from any burden of paying arrears, which may adversely effect the fiscal situation. 

Most significantly, in the eve of general election, the Govt. may spread a "feel good" situation among the employees without having to pay an extra penny from the exchequer. In the other hand merging D.A. with basic pay will lead to a considerable expense and as there is definite negative recommendation of sixth CPC in this respect, Govt. can easily deny this demand. 

After formation of seventh CPC, if the ruling party fails to come back in the corridors of power, the entire liability will have to be borne by the new Govt. So, it’s a win win situation of the ruling party and most likely, it will be announced in the later half of the year.

Subject: Introduction of online reservation system in the reservation/allotment of casual hostel accommodation in the Central Government Touring Officer’s Hostel/Holiday Home/Guest House at Delhi.

With a view to provide for choices & convenience of the applicants for reservation of casual hostel accommodation in the Central Government Touring Officer’s Hostel/Holiday Home/Guest House at Delhi, it has been decided to introduce automated online reservation / allotment system w.e.f. 01/05/2013.

2. For this purpose only online applications will be accepted henceforth. Applicants will apply for reservation by filling up the required application form online. After completing the process online, the applicant will have to take a print out of his/her application and get it verified / forwarded from his/her office and send it along with payment (Demand Draft) & other allied details/documents ete.. to “Online Reservation Cell, F - Block, C.R.Hostel Kasturba Gandhi Marg, New Delhi - 110001" for confirmation of his/her booking request. On receipt of the filled up application with payment of room rent (Demand Draft), duly verified & forwarded by the controlling office of the applicant (in case of Retd. Government Officers attested copy of PPO), his/her booking request will be processed. Applicant can monitor the status of his/her booking request online through the website.

3. With effect from 16/04/2013 onward, only online applications for reservation of casual accommodation in the Central Government Touring Officer’s Hostel/Holiday Home/Guest House at Delhi will he accepted.

4. No manual application will he accepted from 16/04/2013 onwards for the reservation of casual accommodation in the Central Government Touring officer’s Hostel/Holiday Home/Guest House at Delhi seeking reservation for the period from 01/05/2013 onwards.

5. Manual applications received up to 15/04/2013 for the reservation of casual accommodation in the Central Government Touring Officer’s Hostel/Holiday Home/Guest House at Delhi seeking reservation for the period upto 30/04/2013 have been accepted and casual accommodation is reserved subject to availability.

6. Detailed procedure/guidelines as laid down in the OM dated 21/12/2013 and terms & conditions and other relevant information regarding reservation of Delhi central Government Touring officer’s Hostel/Holiday home/Guest House accommodation are available on the website of this Directorate i.e.www.estates.nic.in / Holiday Homes website and holidayhomes.nic.in shall be applicable.
